The men quarreled over ownership of an ax and a barrel of coal Lovier had a bed slat and Thomas began shooting when Lovier drew his revolver. Thomas fired striking Lovier in the left side and leg. Lovier fired four times, one shot piercing Thomas head. Both fell dead within 20 feet of each other Thomas was 38 years old and unmarried.
